Privacy Policy

IMAGIkid ("we," "us," or "our") is committed to protecting the privacy of you and your child. This Privacy Policy explains what information we collect, how we use it, and your rights when you use imagikid.net (the "Site") and our AI-personalized children's storybook service.

Information you provide directly:

• Child's photograph — uploaded by you to generate AI illustrations. This is the only biometric-adjacent data we handle.
• Child's name, age, and gender — used to personalize the story text.
• Child's interests and appearance description — used to personalize illustrations and story details.
• Parent/guardian email address — used to deliver your completed storybook PDF and transaction receipts.
• Payment information — processed exclusively by Stripe, Inc. We never see, store, or handle your full credit card number.

Information collected automatically:

• Standard web server logs (IP address, browser type, pages visited) for security and analytics. This data is not linked to your identity.
• Cookies may be set by Stripe for payment processing and fraud prevention.

• To generate your personalized AI-illustrated storybook PDF.
• To deliver the completed PDF to your email address.
• To process your payment through Stripe.
• To respond to customer service inquiries.
• To improve the quality and accuracy of our AI illustration service.

We do not use your information to send marketing emails without your explicit consent, nor do we sell, rent, or share your personal data with third parties for advertising.

When you upload your child's photo, it is transmitted over a secure (HTTPS) connection and stored in Vercel Blob, a secure cloud storage service. The photo is accessible only to our AI generation service (Replicate, Inc., which runs the FLUX Kontext Pro model) for the sole purpose of creating your storybook illustrations.

We do not train AI models on your child's photo. We do not use it for facial recognition beyond storybook illustration. We do not retain copies of your child's photo after deletion.

IMAGIkid is a service used by parents and guardians to create storybooks for their children. We do not knowingly collect personal information directly from children under 13. All account activity, photo uploads, and purchases are performed by adults (parents or guardians) on behalf of their children.

By uploading a photo of a child under 13, you represent that you are that child's parent or legal guardian and that you consent to the collection and use of that photo as described in this Privacy Policy.

If you believe we have inadvertently received information from a child under 13 without parental consent, please contact us immediately at brandi.lynn.eckert@gmail.com and we will delete it promptly.

If you are a resident of Illinois or another jurisdiction with biometric privacy laws, please note the following:

• Your child's photo may be processed by our AI service to extract facial geometry for the purpose of generating illustrations. This constitutes "biometric information" under the Illinois Biometric Information Privacy Act (BIPA) and similar laws.
• By uploading a photo and using our service, you provide informed written consent to this processing as described in this Privacy Policy.
• We have a written retention schedule: biometric data is deleted within 24 hours of purchase, in accordance with BIPA's requirements.
• We do not sell, lease, trade, or profit from biometric information.
• We do not disclose biometric information except to our AI generation service provider (Replicate, Inc.) for the sole purpose of creating your storybook.

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the GDPR and applicable laws:

• Legal basis: We process your data based on your consent (photo upload) and contract performance (delivering the storybook you purchased).
• Right to access: You may request a copy of personal data we hold about you.
• Right to erasure: You may request deletion of your data at any time. Photos are deleted automatically within 24 hours, but you may contact us to request immediate deletion.
• Right to object: You may object to any processing beyond what is strictly necessary to deliver your order.
• Data transfers: Our services are hosted in the United States. By using our Site, you consent to the transfer of your data to the U.S.

We use the following third-party services, each with their own privacy practices:

• Replicate, Inc. — AI image generation (FLUX Kontext Pro model). Processes uploaded photos to generate illustrations.
• Vercel, Inc. — Hosting and temporary file storage (Vercel Blob).
• Stripe, Inc. — Payment processing. Stripe's privacy policy governs all payment data.
• Resend, Inc. — Email delivery of your completed storybook PDF.
• Anthropic, PBC — AI analysis of photos to auto-generate appearance descriptions (Claude Haiku model).

We do not sell your personal information to any of these parties or any other third parties.

We use industry-standard security measures including HTTPS encryption for all data in transit and secure cloud storage for data at rest. However, no method of transmission over the internet is 100% secure. We encourage you to notify us immediately if you suspect unauthorized access to your data.

• Delete your photo immediately: Contact us at brandi.lynn.eckert@gmail.com to request immediate deletion before our automatic 24-hour deletion.
• Opt out of communications: Every email we send includes an unsubscribe link. You may also contact us directly to stop receiving any communications.
• Access your data: Contact us to request a summary of any personal information we hold.

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top. Your continued use of the Site after any changes constitutes your acceptance of the updated policy.
